1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Vcaptiona.com ("we," "us," or "our"), concerning your access to and use of the Vcaptiona web application and srt generator.

By signing up or using our service, you agree that you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these terms, then you are expressly prohibited from using our services.

2. Use of Service & Account Credits

We offer a web application that transcribes audio files to subtitles using AI algorithms.

• Free Trial Credits: Every new account receives a trial of 5 free transcription credits. Credits represent a specific duration of audio transcription.
• Fair Credit Usage: You may not create multiple spam accounts to bypass the 5-credit trial limits. Abuse will lead to IP bans and account terminations.
• No Automated Exploits: Scraping, automating queries, or abusing our transcription endpoints outside the user interface is strictly prohibited.

3. Uploaded Content & Guidelines

You maintain full ownership of any audio recordings and resulting transcripts or SRT files generated. However, you must adhere to the following input rules:

• You must possess all necessary rights and licenses for the media you upload.
• You may not upload content that is illegal, defamatory, infringes intellectual property, or contains viruses and harmful software exploits.

4. Intellectual Property

Unless otherwise indicated, the Vcaptiona landing page, application branding, particle effects, custom algorithms, styles, code, and waveform viewer layouts are our proprietary property and are protected by copyright, trademark, and other intellectual property laws.

5. Limitation of Liability & Warranties

Our services are provided on an "as-is" and "as-available" basis. We make no guarantees that transcripts will be 100% accurate, error-free, or meet your exact workflow requirements. We are not liable for any direct or indirect losses caused by data loss, downtime, inaccurate timestamps, or service disruptions.

6. Changes to Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service at any time. We will alert you about any changes by updating the "Last updated" date of these Terms.
